Based upon the foregoing and for the reasons set forth above, the Defendants’ motion for protective order is hereby DENIED, however, the Plaintiffs’ use of the information obtained from the subpoenas is limited and may not be used by the Plaintiffs to initiate litigation, threaten potential litigation, or to seek to resolve potential litigation based upon alleged signal piracy.

Conclusion
Based upon the foregoing and for the reasons set forth above, Plaintiffs’ motion to compel is GRANTED as to Request for Production No. 117 and DENIED as to Interrogatory Nos. 9 and 10.

Defendant’s motion for protective order is DENIED, however, the Plaintiffs’ use of the information obtained from the subpoenas is limited as set forth above.

Thank heaven for some people as the US Courts decision does not be apply to Canada as it is out of that courts jurisdiction.

Sometimes when there is no precedent in Canadian law, then the canadian courts have look into British and US court decisions for quidance. Govern yourselves accordingly. Later!!!!!!!!

Sounds like the end is near- if they have to divulge such info what is next? I wouldn't be looking for any fixes period now. Sounds like Viewtech is taking it big time in court. What sets them apart from Coolsat?

i don't see why you guys are freaking out.

coolsat receivers are among the best of the best TRUE fta receivers. I use my coolsat clone (Visionsat) for FTA reception and for peaking my motorized setup across the arc. I didn't buy it direct, but I don't care. I'm not doing anything illegal with it.

Remember, the burden of proof rests on the prosecuting party.

Re-read what I've hi-lited, it says that echo CAN NOT go after the end user in any way for any purpose.

Echo is limited to only see who the customers are and won't be able to prosicute them at ANY time.

I don't see a problem with them having the names of the stb owners, heck, they more than likely have most of the names in THEIR OWN customer data base already

I read a write up on this and Viewtech has no idea who purchases their boxes so the buyer is safe. Those that sent in boxes for repair are the ones that thier information is being supplied to Echostar. So if you sent one in to get fixed you need to be aware.
Fortunatly, this was posted when the ruling first came out that when a box was sent in that the chip was going to be removed and the information sent to Echostar. Hopefully those that read that posting didn't send their boxes in for repair.

I merely meant that Coolsat is bankrupt now since they could not come up with the $100,000,000 they owe in damages to DN. Can Viewtech be ruled any differently?
