DIRECTV Lawsuit Moves Forward

A California Superior Court judge has ruled that a lawsuit targeting DIRECTV's cancellation policies may move forward.

The case, which centers around the DBS provider's early cancellation fees, was brought by Consumer Watchdog attorneys Harvey Rosenfield and Pamela Pressley and claims that DIRECTV has been unlawfully imposing early cancellation fees of up to $480 and taking the money out of customers' bank accounts without permission.

In response, DIRECTV said it is "already defending against these baseless allegations in federal district court. While this copycat lawsuit was filed later and will be proceeding concurrently with the federal litigation, neither of the lawsuits has any merit. We believe our early cancellation fees are lawful, fair and reasonable and all relevant terms and conditions of our customer agreements are carefully disclosed to each customer, including the customer's option to accept discounted or free equipment and an installation offer in exchange for their agreement to remain a customer for a period of time (24 months). And if the customer chooses instead not to keep that commitment, there is a pro-rated cancellation fee. Customers are also informed that they’re required to provide us with a credit or debit card when they activate their service and they agree that the credit card will be used for any unpaid balance when they disconnect the service."

Hum... gotta watch your bank accounts when dealing with the providers...

Six months later I get a bill for $198.00 so I called them to see why they were sending me this bill. Here's the killer explanation they gave me, Well you said that you were financially unable to pay for services and we discontinued the service for six months and for the last two months you have not paid your bill so that is why you have accumulated two months of service. To my surprise they had no answer. So I proceeded to tell them that I was going to get legal representation and sue them not for $198.00 but for a few millions so that the company would not do this to anybody else and how quickly the tables turn. They said that won't be necessary we will remove the amount from your direct t.v. account, I said what account I don't have an account with you anymore. They responded we will delete any information pertaining to your closed account. I said if I receive another bill from direct t.v. I would move forward with a lawsuit for illegally trying to charge for a discontinued service. It was the best feeling to know I had the upper hand, and that they were made to feel like I did when I got their bill. But like I said these people are like leaches, they stick to you and they don't want to let go. I think they learned their lesson. Then again maybe not......

Another great post,
Like to see the big monster get spanked every once in a while, I think that most of us would like to be able to choose our programing, I only watch about four channels, if I watch at all,( kind of a talk radio guy myself), but every channel has a value, So give me my four channels, I will pay you, and that is it, I don't want the 150 channel package, to get my four channels,

well i had the same problem i use to live in an apt and i have there service and i was happy with the HD and all one day my landloard told me i need to move the dish from where i had it and that i can no longer have it where i had it soo i called DTV and told then that they did not belive me soo they called my landloard and talked to them not i had my dish cancled and returnd the box they tell me all is fibe six months down the road i get a bill of $850 i was like wow why is that when i called then well you did canclled the dish but there was a you had a balance doo and i did not soo i checked my bill and all was fine i talk to them no luck my wife was ok i deal now with them soo she called them and asked for the manager of the departmend and told them all like it was soo they where like no and my wife said ok i want you too record me i request that you record me about this now and i want you too send me a copy of that soo that i can use that at the court my lowyer will contact you soon.. Boom no more bill all was fine and i had no more bill from them that's my story guy's and that was a few months ago as well...

Wow,
Good that your wife got the charge dropped, But watch your credit report, My dad went through a similar thing with Dish Network, Got it all taken care of, Six months later showed up on credit report when buying new truck, He finally got it off credit report, but man what a pain...
